NBC New York, A Judge denied Alexander Smith’s request for a temporary restraining order so that he could keep his three-inch beard.

Smith had filed the motion claiming the department’s rules violated his religious freedom.

Smith is a born-again Christian.

Instead, he has decided to shave his beard in order to take care of his family.

The Fire department has rules against facial hair saying it can affect the seal between the breathing masks and a person’s face.
